China AI chatbot pornography case 2026: Developers Appeal 4-Year Sentence

Developers of the AlienChat AI bot are appealing a prison sentence in the landmark China AI chatbot pornography case 2026. The case examines legal liability for AI-generated content.

Four years behind bars for AI-generated dialogue. In a case that marks a major turning point for the AI industry, two Chinese developers are appealing their convictions for distributing pornography via their AI companion app. According to the South China Morning Post, the appeal hearing began at the Shanghai First Intermediate People’s Court on January 14, 2026.

The China AI Chatbot Pornography Case 2026 and AlienChat Scandal

The defendants, identified by the pseudonyms Wang and Li, created an "emotional companionship" chatbot named AlienChat (AC) in 2023. While marketed as a digital friend, the service reportedly allowed paid users to engage in explicit sexual conversations. A lower court previously sentenced the lead developer to 4 years in prison and his colleague to 1.5 years for "creating pornographic material for profit."

A random sampling of 12,495 chats from 150 paid users revealed that 3,618 of these contained obscene material.

A Technical Debate Over Developer Liability

The defense argues that developers shouldn't be held criminally liable for spontaneous outputs generated by an AI model. However, prosecutors pointed to the 24,000 paid users out of 116,000 total registrants as evidence that the business model incentivized the creation of illicit content. The hearing has been adjourned to await expert opinions on the technical boundaries of AI control.
